Anyone in a managerial or authority position who uses or condones any form of sexual actions to be in charge of , influence, or affect the vocation, pay, or job of a military member or civilian employee who makes deliberate or repeated unwelcome verbal comments, gestures, or physical conduct of a sexual nature in the workplace is also engaging in Sexual Harassment .Sexual harassment violates acceptable standards of integrity and impartiality required of all ARNG personnel, and interferes with mission accomplishment and unit cohesion.  Sexual harassment is not limited to the workplace, but can also occur in the work related environment.

Sexual harassment is a form of sex bias that involves annoying sexual advances, sexual favors request  and oral or physical behavior of a sexual nature when: submission to such conduct is made either openly or wholly a term or circumstance of a person's livelihood, pay or career; or compliance to or refusal of such demeanor by a person is used as a basis for career or employment decisions affecting that person; or such conduct has the purpose  or effect of unreasonably interfering with an individual's work performance or creates an threatening, unfriendly or unpleasant working atmosphere. The aim of Sexual Assault Prevention and Response Program is to strengthen the Army's commitment to abolish incidents of sexual assault using a comprehensive policy that majors on enlightment and prevention, training and education, response, reporting, and accountability. This policy fuels sensitive care and secretive reporting of sexual harassment and accountability for those who commit these crimes. For the purposes of this policy, confidential reporting is defined as allowing a Soldier to report a sexual assault to particular individuals. The mission of the Sexual Assault and Prevention Program is to prevent sexual assaults through increasing awareness of the continuous sexual assault in the military, enlightening all service members about sexual assault prevention, and protecting the rights and dignity of victims. The quality and effectiveness of unit training are of core concern. The most effective approach to training to prevent sexual harassment is through interactive discussion in small groups of mixed gender. Situational vignettes or scenarios should be used to facilitate discussion among unit Soldiers and civilians. Role play is also an effective training means. The training emphasis should be up to the level of the experience and breadth of responsibilities of each target group. Unit commanders should attend this training and evaluate its scope and quality. Unit training for juniors and civilian employees will focus on defining sexual harassment and gender discrimination, sanctions that may be used to punish perpetrators, ways for Soldiers to deal with sexual harassment and techniques of filing a complaint by complaint system. Unit training or professional development training for junior officers, noncommissioned officers and civilian supervisors will reinforce the aforementioned training. In addition, emphasis should be placed on promoting a healthy work conditions within the section or unit as well as on methods for receiving, handling and resolving sexual harassment disputes. Training on the complaint system must include leader responsibilities in processing informal and formal complaints. It must emphasize the prevention of reprisal actions against complainants.

Prevention is the best means for the reduction of sexual harassment. Leaders must take immediate actions to eliminate any real or expected sexual harassment brought to their knowledge. In some cases, the harasser might not know the conduct is offensive or unpleasant. Be firm, clear, and specific about what is offensive and, if necessary, report the behavior to get the issue resolved. All allegations of sexual harassment ideally should be handled at the lowest level with appropriate seriousness. If not, Soldiers and family members should report it to the chain of command, the Inspector General, or the Equal Opportunity Advisor. It is therefore evident that the various forms of sexual harassment do more harm for the realization of a unit's goals. Proper training and general awareness should be carried out to see to it that the victims of the same crime have justice exercised. (Lafayette, 2010).
